If, as of the date of sale, the Owner has filed a criminal complaint that is pending, the sale will be communicated to the Court, and the Owner will withdraw from the proceedings as a private prosecutor. The occupancy status and/or any impediments preventing free access to the property by technicians would prevent: i) its official valuation as required by Order ECO/805/2003 of March 27, meaning that the property, while the occupancy situation persists, could not be mortgaged, and consequently, mortgage financing could not be obtained for this type of property, whose acquisition would require the provision of other types of guarantees if financing were sought; and ii) the owner obtaining the energy efficiency certificate. The sale price of this property has been determined based on the aforementioned circumstances, which have resulted in a lower value, and which must be expressly accepted by the buyer upon formalizing the transfer of the property.
